Covenants Committee

The Covenants Committee Charter

 The Covenants Committee is charged with monitoring homeowner compliance of restrictive covenants and periodically reporting violations to the Board of Directors.

  1. The Committee will consist of 3 to 6 members. One member will be an elected member of the Board of Directors. Duration of membership will not exceed 2 years unless there are insufficient volunteers to serve on the committee.
  1. Members of the Covenants Committee shall survey all properties and lots quarterly or more often throughout phases 1-4 the Hunters Ridge subdivision.
  1. Members of the Committee may also receive, review, and investigate notification of covenant violations from property owners.
  1. Where necessary, the Committee will interpret and determine what constitutes a violation of the covenants.  If members are not in unanimous agreement of the interpretation, the majority opinion governs the determination.
  1. The Committee shall present first time offenses with a correction timeframe to the offending property owners via letter. Additionally, the Committee members shall record all violations in writing and present them to the officers and board members. 
  1. Recommendations for corrections shall be made to the officers and board members.
  1. The Covenants Committee will follow-up with compliance of the offenders and make further recommendations if necessary.
    1. Homeowners who continue to be out of compliance will be reported to the Board of Directors (BOD).
    1. Upon approval of the BOD, a letter will be sent to offending property owners notifying them of continued non-compliance, a timeframe to correct or appeal the offense to the covenants committee and possible sanctions/penalties authorized under NC General Statutes.
    1. If compliance or appeal is not executed within the directed timeframe, a fine shall be assessed against the offending homeowner secured by a lien against the property in question. If after an appeal hearing it is determined that a violation exists, a fine may be imposed for the violation if not corrected. Fines not to exceed $100 per day may be imposed for the violation without further hearing, for each day more than 5 days after the decision that the violation occurs.  
  1. The Covenants Committee can meet to review the covenants and make future recommendations for amending the covenants to the officers and board.
  1. The Covenants Committee shall meet quarterly or more often if necessary and submit a written report to the BOD.

 

 

January 2008

Architectural Review Committee

General Information for the Architectural Review Committee was included in the minutes of the last General Meeting of the Home Owners Association.  The committee has been active in involvement with, and approval of the following construction activities in Phases I through IV.  As you can see constriction and improvement activities continue at a high level and are encouraging for the future growth of Hunters Ridge.

          • 3 new homes
          • 4 sunrooms
          • 6 fences
          • 1 shutter color change 

Please remember to contact the Architectural Committee if you are contemplating changes to your properties appearance and additions.

 

Safety Committee

At the request of the HOA, the Safety Committee conducted a signage survey to assess STOP signs that were in place, their condition, and on any that might need to be installed.  The Safety Committee was also asked to recommend any other signs that they thought might be needed.  The committee walked Hunters Ridge Phases I-IV, and submitted a report.  Subsequently, deteriorated and absent STOP signs were replaced with new ones for the benefit of all. 

Prior to The Hunters Ridge of New Bern Home Owners Association the Safety Committee contacted the State Trooper office and arranged for a representative to speak at the home owners meeting of January 24th, 2008 so that those present might have a better understanding of the law and how it applies to Hunters Ridge and the persons in it. 

In addition to this, the Safety Committee reported numerous incidents to law enforcement officials including, a vandalized mailbox, ATVs, trail bikes, and golf carts being operated on Hunters Ridge roads by underage operators without proper safety gear, raucous and unsupervised youths late at night, and vehicles repeatedly speeding near small children.
